The regular meeting of the Yankton County Commission was called to order by Chairman Jensen at 4:00 PM on Tuesday, July 17th, 2012.
Roll Call was taken with the following Commissioners present: Donna Freng, Bruce Jensen, Mark Johnson, Garry Moore and Allen Sinclair.
Action 12289C: A motion was made by Sinclair and seconded by Freng to set the agenda with the following additions/changes: Provisional Budget, Highway Shop plaque

Chairman Jensen announced Allen Sinclair and Garry Moore have been appointed to reorganize the County Highway shop.
The Board discussed disposition of the old highway shop property and the plaque will be ordered for the new shop if all are in agreement.
Action 12302H: A motion was made by Sinclair and seconded by Freng to have the property appraised by a certified commercial appraiser and that required notices be published to sell the property by sealed bids on September 5th, 2012.

Action 12303C: A motion was made by Moore and seconded by Sinclair to adopt the following:
RESOLUTION FOR
DECLARATION OF DISASTER
WHEREAS, Yankton County, South Dakota, is suffering agricultural-related damage brought on by ongoing drought conditions; and
WHEREAS, Yankton County Farm Service Agency has submitted a âFlash Reportâ to the South Dakota State FSA Office in Huron, SD; and
WHEREAS, Yankton County Emergency Management Board met on July 13, 2012 for the purpose of completing required documentation; and
WHEREAS, according to the information provided by the Yankton County FSA Office, Yankton County precipitation is 75% below normal since January 1, 2012.
AND, WHEREAS, the immediate impact of these drought conditions are loss of alfalfa and winter wheat production with definite impact on corn and soybean production according to the FSA Office.
NOW, THEREFORE, BE IT RESOLVED by the Yankton County Board of Commissioners at their regular meeting held July 17th, 2012, that, based on information received by the Yankton County FSA Office and the Yankton County Emergency Management Board, is hereby requesting that the Governor declare a disaster to exist in the County of Yankton, South Dakota.

YANKTON COUNTY
RESOLUTION TO PROVIDE FOR TEMPORARY
EMERGENCY REGULATION OF FIRE HAZARDS IN
YANKTON COUNTY
WHEREAS, the Commissioners of Yankton County are charged with the protecting the health and safety of the citizens of Yankton County, including all property situated therein; and
WHEREAS, South Dakota Codified Law (SDCL) 7-8-20(18) authorizes the Yankton County Commission to prohibit or restrict open burning, after consultation with local fire officials and law enforcement officials, in order to protect the public health and safety; and
WHEREAS, the Yankton County Commission has consulted with local fire officials and law enforcement officials concerning the threat of wildfire from open burning under certain climatic conditions; and
WHEREAS, the Commissioners of Yankton County have determined that in the interest of public health and safety, it will prohibit open burning (open fire) when climatic conditions indicate the threat of wildfire and other dangerous fire hazards within Yankton County; and
WHEREAS, for purposes of this Resolution, âopen burningâ shall be defined as any outdoor fire, including but not limited to campfires, warming fires, charcoal grill fires, or the prescribed burning of fence rows, fields, wildlands, trash and debris. This Resolution excludes fires contained within liquid-fueled or gas-fueled stoves, fireplaces within all buildings, charcoal grill fires at private residences, and permanent fire pits or fire grates located on supervised developed picnic grounds and campgrounds; and
WHEREAS, conditions of wildfire and dangerous fire hazards now exist in Yankton County;
NOW, THEREFORE, BE IT RESOLVED, that the Yankton County Commission enact this Resolution on an emergency basis and impose a burn ban to prohibit or restrict open burning in Yankton County, and;
BE IT FURTHER RESOLVED that the ban will be in place until lifted by action of the Yankton County Commission, after consultation with local fire officials and law enforcement officials; and
BE IT FURTHER RESOLVED that a fine not to exceed five hundred dollars for each violation, or by imprisonment for a period not to exceed thirty days for each violation, or by both the fine and imprisonment, if found in violation of this Resolution, as per South Dakota Codified Law 7-18A-2, and that the costs for suppressing any fire, including response fees, mutual aid assistance from other agencies or fire departments, reimbursement to governments for suppression efforts and compensation to the firefighters for time lost from their employment, be born directly by the individual or individuals responsible for setting the fire.

The ambulance report for the month of June, 2012 was presented by Steve Hawkins. The
department responded to 133 calls in June with 109 1st calls,125 2nd/3rd calls, 11 transfers and 6 Standby and 6 Command/supervisor responses. $77,868 was billed out in June and $50,100 was receipted in for June, 2012.
Action 12305A: A motion was made by Johnson and seconded by Freng to adjust the following bills: Medicare adjustments $16,707.58, Medicaid adjustment $3,474.94 and $898.25 in miscellaneous bills and the liens cancelled.

record, the report of the Ambulance Department for June, 2012.

Becky Frank and Muriel Pratt, Town of Lesterville, appeared to discuss two Yankton County properties previously taken for tax deed. The properties have county liens, delinquent taxes and interest and Town of Lesterville special assessments against each. The issue will be returned to the table after review with the States Attorney.
The scheduled supplemental budget hearing for the Safety Center was held at 5:30 PM.
Action 12308SC: A motion was made by Freng and seconded by Johnson to approve a supplemental budget of $13,000 from general fund reserve to the Safety Center budget for ductwork maintenance not to exceed $13,000.

Action 12309C: A motion was made by Sinclair and seconded by Freng to approve the application of WR Capital I LLC dba Minerva's Grill & Bar for a special events (single event) liquor license for September 8th, 2012 at Lewis & Clark Resort - The Lodge in Section 17, Township 93N, Range 56W.

The issue of ATV complaints was returned to the table. Melvin Fish and Lorin Kuehler appeared to voice objection to the County preventing ATV use in right of ways. The issue was tabled until the next Commission meeting.
The commission is in receipt of requests from the City of Yankton and Yankton Public Schools for free access to the County's Beacon website. Discussion followed and resulted in the following actions:
Action 12310C: A motion was made by Sinclair and seconded by Freng to approve allowing the City of Yankton full access to the website at no charge, contingent upon the City signing the standard contract. Said contract is renewable by request on an annual basis.

Bill Beukema, Dakota Plains Ag Center, LLC, updated the Board regarding the company's plans for construction of a commodity handling operation in Yankton County.
