MUST RESIDE WITHIN FIVE (5) MILES OF CITY LIMITS.EDUCATION, TRAINING AND EXPERIENCE REQUIREMENTS: A candidate for this position is required to have a Juris Doctor Degree and three (3) to five (5) years experience in the practice of law, with one (1) year concentrating on the representation of municipalities and municipal officials preferred or equivalent combination of education and experience. A candidate must have a license to practice law in the South Dakota courts and a valid drivers license. Knowledge of the local, state and federal laws which govern municipal operations; Knowledge of legal research materials and other resources; The ! ability to provide consistent and timely responses to requests! for legal assistance; Skills in maintaining effective working relationships with customers, other personnel, superiors, subordinates and other offices and agencies; Strong skills in the preparation and forceful presentation of legal opinion, written and verbal, and advocacy on behalf of the City; and Strong negotiation skills and tact.PRIMARY OBJECTIVE OF POSITION: Employee works under the policy direction of the Governing Board.

Employee establishes long and short-range plans and objectives, own performance standards and assumes direct accountability for department and citywide results. Employee exercises control over all legal needs of the City, including the prioritization and completion of priority items. Employee is expected to resolve all projects and assignments, coordinating with other administrative staff as necessary. Employee has full access to confidential information including personnel files, collective bargaining negotiations, criminal investigation! s and records and lawsuits affecting the City.MAJOR AREAS OF ACCOUNTABILITY AND PERFORMANCE: The level of judgment and the complexity required by this position is extensive.

The nature of the position is to provide advice to municipal officials so that avoidable problems do not occur and to represent those officials when unavoidable problems do happen; work involves the application of specialized legal knowledge and full understanding of municipal operations; analysis and application of state, federal and local laws to municipal operations such as hiring; contracting, law enforcement, and municipal regulation.Errors can result in monetary loss, injury to other employees and/or legal repercussions. Erroneous legal advice or decisions can have significant negative impact on the City.Employee has occasional contact with the public, to receive calls and complaints about violations or potential violations of City ordinances; complaints from individuals ticketed by the P! olice department or general questions or complaints about the City. The! re is frequent contact with City department heads and other management staff and regular contact with various county, state, and federal agencies to resolve or avoid a variety of concerns or disputes. Contact with the public is primarily by phone, occasionally in person or in writing; contacts with staff or others includes phone, in writing, by fax, in person, and by email.
